Compensation related to Spinal Cord Injury in Indiana

In order to receive compensation for a spinal cord injury claim in Indiana you must prove that the person who caused the injury was negligent. That means the person failed to exercise ordinary care. In Indiana you must prove:

  • You suffered damages
  • The existence of a duty owed to you by the person who caused the injury
  • The other person failed to carry out the duty they owe you
  • The other persons failure caused you to have the injury

Under Indiana law if two or more individuals are responsible for the injury because they were each careless they are each responsible for a proportional amount of the damages.

A spinal cord injury that is caused by using a consumer product may cause the seller of the product to be responsible under the "products liability" legal theory if:

  • The product was defective and unreasonably dangerous
  • The defect caused the injury
  • You suffered damages
  • The product reached you without substantial change from when it was sold
  • The seller usually sells the product, and should have foreseen that you would be the type of person who would buy or use it
Under Indiana law, the person who injured you is responsible for:
  • Past, current and future estimated medical expenses
  • Time lost from work
  • The cost of hiring someone to do household chores when you cannot do them
  • Your emotional distress, including anxiety, depression, and any interference with your family relationships
  • Change in your future earning ability
  • Any other costs that are a direct result of your spinal cord injury

Indiana law protects you if you've suffered a spinal cord injury due to another's negligence. Clearly identifying responsibility and ensuring that the appropriate compensation is obtained is the role of a spinal cord injury attorney.
